Terms & Conditions of Use

If you are advertising with us, you also accept and agree to comply with all of the terms and conditions of our Membership Services Agreement. Please see our Privacy Policy for terms applicable to our data collection and use practices, the terms of which are incorporated in this Usage Agreement by reference.

We reserve the right to refuse service, terminate accounts, and/or cancel orders at our discretion, including, but not limited to, if we believe that customer conduct violates these Terms of Use or applicable law, or is otherwise harmful to the interests of BPP, its owners, affiliates, licensors or licensees.

Updates and Effective Date

We reserve the right to change the terms of this Usage Agreement from time to time, as we deem appropriate. Such changes, modifications, additions or deletions shall be effective immediately upon posting unless otherwise indicated. If we make a change to this Usage Agreement that reduces or significantly changes your rights or responsibilities hereunder, we will notify you via email to the email address you have provided to us (for example, in connection with setting up an account) or via a notice on our Services. If you object to any of the changes we make, your choice is to stop using our Services. Your continued use of the Services after such changes are posted will be deemed to constitute your agreement to and acceptance of such changes.

Use at Your Own Risk

We provide the material available through the Services for informational purposes only. Before you act on any information you have found on the Services, you should independently confirm any facts that are important to your decision. With respect to our classified advertising services and any business listings posted in connection therewith, please note that we do not sell the advertised items directly and are not involved in any actual transaction between any seller and buyer; without limiting the foregoing, we do not endorse, guarantee or insure any item or service advertised or the completion of any transaction or collect or process payment, act as an escrow service or transfer title, nor do we warehouse, store, ship or deliver any item or service that is advertised.

Special Note for Parents

Our Services are intended for a general audience and were not designed for children, and we are not responsible for any access or use of our Services by children. By way of example, our Services are not intended to sell products for purchase by children. If you are under 18, you may use our Services only with the involvement of a parent or guardian. In order to purchase products or services from our Services or advertise on any of our Services, you must be at least eighteen (18) years of age and use a credit card.

Posted Materials

You may have the opportunity to post or otherwise submit information, concepts, inventions, techniques, know-how, data or ideas (collectively, “Ideas”) to us via the Services, whether by submission to a public area of the website or mobile app (e.g., blogs or message boards) or by other communication to us through email or other means of electronic communication facilitated by the Services. Although we do not claim ownership of content that you post, by submitting communications, materials or Ideas to us or any public area of the Services, you grant BPP, its owners, affiliates and licensees the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, aggregate, translate, publicly display, publicly perform and distribute such material and Ideas (in whole or in part), alone or as incorporated into other works in any form, media or technology now known or hereafter, on a worldwide basis. We have no responsibility for the content of such third-party sites and shall not be liable for any damages or injury arising from that content or your use, reliance on or access to such third-party sites. Any such links to third-party sites are provided as merely a convenience to the users of the Services, and such links do not imply endorsement by BPP of such other third-party sites or the content contained therein. BPP disclaims all liability with regard to your access to such linked web sites, and access to any other websites linked to the Services is at your own risk. Use of Communications Services

We may provide a variety of services on the Services through which you can directly interact with others, such as email services, blogging services, chat messages, communications tools, forums, classifieds and other user-submitted advertising, and other public posting areas (“Communications Services”). We cannot and do not review every posting made in our blogs, chat messages, forums, and other areas available for public postings. You may well read any given posting before anyone on our staff does. You can expect these areas to include information and opinions from a variety of individuals and organizations other than us. We shall have the right, in our sole discretion, to delete, move, refuse to post, or edit any messages, listings or other postings that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons.

By using the Services, you agree not to post, submit or transmit through the Services any material that violates or infringes in any way upon the rights of others, that is unlawful, threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane, misleading, fraudulent or otherwise objectionable, that encourages conduct that would constitute a criminal offense or give rise to civil liability or otherwise violate any law, or that, without our express prior approval, contains advertising or any solicitation with respect to products or services. Without limiting any other portion of these Terms of Use, you agree that we may, in our sole discretion and without prior notice, terminate your access to the Services and/or block your future access to the Services if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Services. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to us, for which monetary damages would be inadequate, and you consent to our obtaining any injunctive or equitable relief that we deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies BPP may have at law or in equity.


Use of the Services by you for spamming is strictly prohibited. By using the Services, you agree not to use information concerning other users of the Services, or any items such users have listed or searched for on the Services (including listing information, user names, email addresses, telephone numbers, and/or other information), for any purpose other than to explore the potential purchase or sale of the item. You may not post information directed to or collect personal information from any minor.

Disclaimer of Warranties

Limitation of Liability


Without limiting the foregoing, you agree that the entire liability, if any, of BPP, its owners, affiliates, licensors and licensees arising out of any kind of legal claim (whether in contract, tort or under any other legal theory) arising out of your access to or use of, or inability to use, the Services or any information, products or services available through the Services will not exceed the amount that you paid to BPP, if any, for (i) the use of the Services or (ii) such information, products or services.

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, some of these limitations may not apply to you.

Release and Indemnity

You agree to release, defend and hold harmless BPP, its owners, affiliates, licensors and licensees from and against any and all claims, costs, demands, losses, damages and expenses, including, without limitation, attorney’s fees, arising from or relating to:(i) your breach of this Usage Agreement or any matter for which you are responsible or liable under the terms of this Usage Agreement, or (ii) any dispute between you and any third-party, including, without limitation, any other user, any advertiser or any party to any actual, prospective or terminated sale or transaction If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Notification of Claims of Infringement

We respect the rights of all copyright holders and in this regard have adopted and implemented a policy that provides for the removal of content from this website or application under certain circumstances. Information Collected by BPP

When you use our services, we collect a variety of information from and about you and your device(s). Some of this information identifies you directly (such as your name or email address), while some of it is associated with you through your account, profile, or device (like the BPP you choose to save or your location data).

You may use our services to browse for BPP without providing us with any information that identifies you directly, though we may collect other information about you or your device (such as your IP address) to provide our services or enhance your experience

However, when you use other aspects of our services (such as creating an account), we may ask you for information about yourself, such as your name, email address, and phone number. If you use any mortgage tools included on our websites or apps, we might ask you for more sensitive information, such as your income and credit score. Additionally, if you voluntarily contribute any information, such as agent reviews or any comments you provide on a “request information” form, we’ll store that data as well. The sections below more fully describe what information we collect in connection with your use of our different services.

You may also provide information about other people through our services. For example, if you share a business listing with someone, we will collect that person’s email address as part of your account information.

Information You Provide

  • Search Commercial Listings: We provide several tools to help you find a profitable business that you can purchase own your own or as a group. If you provide any search criteria when using our commercial business listing search tools, we save that information so that we can tailor your search results to what you’re looking for. We also help you connect with local commercial real estate agents, property managers, mortgage loan officers, and other commercial real estate professionals. If you choose to contact one of these individuals through our platform, we may ask for your name, email address, and phone number so that we can reach you and connect you with the right person. If you are not comfortable providing us with such information, most commercial business listings also include a phone number or email address for the listing commercial real estate professional, which you can use to contact the professional directly. Any information you provide directly to a commercial real estate professional is not governed by this Privacy Policy or subject to BPP’ control.
  • Commercial real Estate Professionals: If you are a commercial real estate professional that signs up to advertise on our site, we will collect your contact and payment details, along with professional information such as brokerage affiliation, associated listings and sales, and licensing history.
  • Job Applicants: If you are interested in a career with BPP, you may find listings of our available positions by visiting the “Careers” link at the bottom of any webpage. If you apply for one or more job opportunities, you will be asked to provide your name, email address, and current city and state. You will also have the opportunity to share with us your resume, cover letter, LinkedIn profile, and other optional materials and information. This information may be collected by BPP or by one or more of our affiliates and used for the purpose of considering your job application.

Information We Collect Automatically

In addition to the information, you give us directly, we collect certain information automatically as you use our services

  • Activity Information: We collect information about how you use our websites and mobile apps, such as your commercial business search history, BPP you view, what you’ve clicked on and other uses of our features, and the amount of time you spend looking at different parts of our websites.
  • Device Information: We collect data about the browsers and devices you use to access our websites and apps. The data we collect includes browser or device model and settings, operating system, unique identifiers (including device ID), and the version of the app you’re using. We also collect data about how your browsers and devices interact with our services, including IP address, crash reports, system activity, and the date, time, and the URL of the site you visited before BPP.
    You can control our collection of certain data, such as your mobile device model or the language your mobile device uses, by adjusting the privacy and security settings on your mobile device.
  • Location Information: If you enable location services on your mobile device, we may collect the location of your device. We use your location to provide you with location-based information, like BPP and commercial real estate professionals in your area, and to offer location-based services. If you don’t want to use these features, you can turn off location services on your device.
    We also collect location information for similar purposes from your browser. You can disable browser location services through your browser settings.
  • Cookies and Other Tracking Tech: We may use various tools (including cookies, pixel tags, web beacons and other similar technologies) to gather information about how you view and use our sites and apps and to enhance your experience with our services. For example, many of our web pages use cookies to help us understand site usage, improve the content and offerings on our websites and apps, or personalize your experience. The use of cookies helps us serve you better by understanding what you’re interested in, tracking trends, measuring the effectiveness of ads, saving your preferences, and storing information you may want to retrieve on a regular basis, such as your favorite BPP. We also allow specific, approved partners to collect data from your browser or device for advertising and measurement purposes using their own cookies or similar tools.
  • Third-Party Advertising: We use third-party advertising companies to provide business listings to you when you use our services. These companies may use information (not including your name, address, email address or telephone number) about your use of our services and other websites and services in order to show your business listings tailored to your interests on our services and other interactive media and/or to keep track of your response to each ad.
  • Google™ Ads: We use the Google Ads remarketing service to advertise on third-party websites (including Google) to previous visitors to our website. It could mean that we advertise to previous visitors who haven’t completed a task on our website (such as using the contact form to make an inquiry). This could be in the form of a business listing on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to a website. Any data collected will be used in accordance with this privacy policy and Google’s privacy policy. You can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to, you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

Data Security

We have in place what we believe to be reasonable physical, electronic and managerial procedures to safeguard and help prevent unauthorized access of, maintain data security for and correctly use the personal information you have provided or that we otherwise collect through our services. However, while such efforts are intended to ensure the confidentiality of your personal information available to us as a result of your use of the services, we cannot and do not warrant or guarantee the absolute safety and security of your personal information. How We Use Your Information

  • Providing & Improving Our Services: We use your information to provide our services to you, such as returning search results as you browse for BPP, and to improve our services and develop new ones. For example, we track how you use our websites and apps and use that information to troubleshoot issues and adjust things to improve your experience.

We may also contact you before passing your information to the commercial real estate professional, to ensure you are connected with the professional best suited to help you.
  • Personalizing Your Experience: We use the information we collect about you and your activity on our services to personalize the services we offer and show advertising, content, or features that we think you might like. For example, we may use your activity information to provide customized search results that match your preferences and prior search criteria.

Sharing Your Information

Information You Ask Us to Share:We share information when you ask us to share it. For example, if you choose to contact a commercial real estate agent, mortgage lender, property manager, or other commercial real estate professional through our platform, we will send them the information you provide on the “request info” or other inquiry form.

Service Providers & Business Partners: When we hire service providers to help operate our business, we may need to give them access to information to provide their service. We allow them to use the information only to perform the service we have asked them to perform. When we partner with other businesses to offer products and services to you, we may share information with those partners only as needed to provide those products and services.

Legal & Compliance Transfers: When BPP needs to share data to satisfy a legal or regulatory requirement, including responding to a subpoena or other lawful government request for data, we will share information only as necessary to comply with that requirement. We’ll endeavor to tell you before sharing your information in these situations, unless we’re prohibited from doing so. We may also share information if needed to enforce our legal rights, detect or prevent fraud or security concerns, or protect public safety. If BPP is involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of its assets, personal information held by us about our services users may be among the assets transferred. In addition, we may disclose personal information for the purpose of evaluating and/or performing the proposed transaction (including in connection with any bankruptcy, liquidation or similar proceedings).

Privacy Choices

Accessing or Deleting Your Account: When you create an account with us, you choose a unique username and password. Commercial real estate professionals that advertise with us are similarly assigned a unique ad ID number. These unique identifiers are disclosed to the user via email immediately upon joining the BPP network. You may access your account to modify or delete your personal information. Alternatively, you may send an e-mail or letter to the following e-mail or street address requesting information about or corrections to your personal information: or To protect your privacy and security, we will take what we believe are reasonable steps to help verify your identity before providing personal information, granting access or making corrections.

Managing Communication Preferences:
Email subscriptions:
We may send you email to any email address you provide for various informational and marketing purposes. For example, if you save a search, we’ll send you emails with new BPP on the market that match your search. If you save a listing, we’ll keep you posted on status updates such as a price change. When you use our transaction services, we’ll send you status updates and other information about your transaction. If you have an account with BPP, you can select your preferences through your account settings. Also, you can manage the types of email you receive by following the instructions included in each email we send you or by filling out our Email Opt Out Form. Please note that even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other non-advertising information.
Calls and texts:
We may collect your phone number when you use certain of our services, such as when you submit a “request info” or other inquiry form or create an account with us. We will contact you through these methods only in accordance with applicable legal requirements, and you always have the ability to opt out of further calls or texts by following the opt-out instructions provided in such call or text.
