Terms & Conditions of Use

We reserve the right to refuse service, terminate accounts, and/or cancel orders at our discretion, including, but not limited to, if we believe that customer conduct violates these Terms of Use or applicable law, or is otherwise harmful to the interests of BPP, its owners, affiliates, licensors or licensees.

Updates and Effective Date

We reserve the right to change the terms of this Usage Agreement from time to time, as we deem appropriate. Such changes, modifications, additions or deletions shall be effective immediately upon posting unless otherwise indicated. If we make a change to this Usage Agreement that reduces or significantly changes your rights or responsibilities hereunder, we will notify you via email to the email address you have provided to us (for example, in connection with setting up an account) or via a notice on our Services. If you object to any of the changes we make, your choice is to stop using our Services. Your continued use of the Services after such changes are posted will be deemed to constitute your agreement to and acceptance of such changes.

You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to us, for which monetary damages would be inadequate, and you consent to our obtaining any injunctive or equitable relief that we deem necessary or appropriate in such circumstances. Miscellaneous

Use of the Services by you for spamming is strictly prohibited. By using the Services, you agree not to use information concerning other users of the Services, or any items such users have listed or searched for on the Services (including listing information, user names, email addresses, telephone numbers, and/or other information), for any purpose other than to explore the potential purchase or sale of the item. NEITHER BPP NOR ANY OF ITS OWNERS, AFFILIATES, LICENSORS OR LICENSEES SHALL HAVE ANY LIABILITY FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN THE INFORMATION CONTAINED WITHIN THE SERVICES. Without limiting the foregoing, you agree that the entire liability, if any, of BPP, its owners, affiliates, licensors and licensees arising out of any kind of legal claim (whether in contract, tort or under any other legal theory) arising out of your access to or use of, or inability to use, the Services or any information, products or services available through the Services will not exceed the amount that you paid to BPP, if any, for (i) the use of the Services or (ii) such information, products or services.

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, some of these limitations may not apply to you.

Release and Indemnity

You agree to release, defend and hold harmless BPP, its owners, affiliates, licensors and licensees from and against any and all claims, costs, demands, losses, damages and expenses, including, without limitation, attorney’s fees, arising from or relating to:(i) your breach of this Usage Agreement or any matter for which you are responsible or liable under the terms of this Usage Agreement, or (ii) any dispute between you and any third-party, including, without limitation, any other user, any advertiser or any party to any actual, prospective or terminated sale or transaction If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Notification of Claims of Infringement

We respect the rights of all copyright holders and in this regard have adopted and implemented a policy that provides for the removal of content from this website or application under certain circumstances. Information Collected by BPP

When you use our services, we collect a variety of information from and about you and your device(s). Some of this information identifies you directly (such as your name or email address), while some of it is associated with you through your account, profile, or device (like the BPP you choose to save or your location data).

You may use our services to browse for BPP without providing us with any information that identifies you directly, though we may collect other information about you or your device (such as your IP address) to provide our services or enhance your experience

However, when you use other aspects of our services (such as creating an account), we may ask you for information about yourself, such as your name, email address, and phone number. If you use any mortgage tools included on our websites or apps, we might ask you for more sensitive information, such as your income and credit score.   • Search Commercial Listings: We provide several tools to help you find a profitable business that you can purchase own your own or as a group. If you provide any search criteria when using our commercial business listing search tools, we save that information so that we can tailor your search results to what you’re looking for. We also help you connect with local commercial real estate agents, property managers, mortgage loan officers, and other commercial real estate professionals. If you choose to contact one of these individuals through our platform, we may ask for your name, email address, and phone number so that we can reach you and connect you with the right person. If you are not comfortable providing us with such information, most commercial business listings also include a phone number or email address for the listing commercial real estate professional, which you can use to contact the professional directly. Any information you provide directly to a commercial real estate professional is not governed by this Privacy Policy or subject to BPP’ control.
  • Commercial real Estate Professionals: If you are a commercial real estate professional that signs up to advertise on our site, we will collect your contact and payment details, along with professional information such as brokerage affiliation, associated listings and sales, and licensing history.
  • Job Applicants: If you are interested in a career with BPP, you may find listings of our available positions by visiting the “Careers” link at the bottom of any webpage. If you apply for one or more job opportunities, you will be asked to provide your name, email address, and current city and state. You will also have the opportunity to share with us your resume, cover letter, LinkedIn profile, and other optional materials and information. This information may be collected by BPP or by one or more of our affiliates and used for the purpose of considering your job application.

Information We Collect Automatically

In addition to the information, you give us directly, we collect certain information automatically as you use our services

  • Activity Information: We collect information about how you use our websites and mobile apps, such as your commercial business search history, BPP you view, what you’ve clicked on and other uses of our features, and the amount of time you spend looking at different parts of our websites.
  • Device Information: We collect data about the browsers and devices you use to access our websites and apps. The data we collect includes browser or device model and settings, operating system, unique identifiers (including device ID), and the version of the app you’re using. We also collect data about how your browsers and devices interact with our services, including IP address, crash reports, system activity, and the date, time, and the URL of the site you visited before BPP.

For example, if you contact us regarding a problem with our site or your account, we may email you to help identify and solve the problem. If you ask us to, we also use your information to connect you to commercial real estate professionals, like when you want to contact an agent to discuss a listing you find on our platform. We may also contact you before passing your information to the commercial real estate professional, to ensure you are connected with the professional best suited to help you.

For example, if you choose to contact a commercial real estate agent, mortgage lender, property manager, or other commercial real estate professional through our platform, we will send them the information you provide on the “request info” or other inquiry form.

Service Providers & Business Partners: When we hire service providers to help operate our business, we may need to give them access to information to provide their service. We allow them to use the information only to perform the service we have asked them to perform. When we partner with other businesses to offer products and services to you, we may share information with those partners only as needed to provide those products and services.

Legal & Compliance Transfers: When BPP needs to share data to satisfy a legal or regulatory requirement, including responding to a subpoena or other lawful government request for data, we will share information only as necessary to comply with that requirement. We’ll endeavor to tell you before sharing your information in these situations, unless we’re prohibited from doing so. We may also share information if needed to enforce our legal rights, detect or prevent fraud or security concerns, or protect public safety. Commercial real estate professionals that advertise with us are similarly assigned a unique ad ID number. These unique identifiers are disclosed to the user via email immediately upon joining the BPP network. You may access your account to modify or delete your personal information. Alternatively, you may send an e-mail or letter to the following e-mail or street address requesting information about or corrections to your personal information: BusinessPartnershipPortal.com or PrivacySupport@BusinessPartnershipPortal.com. To protect your privacy and security, we will take what we believe are reasonable steps to help verify your identity before providing personal information, granting access or making corrections.

Managing Communication Preferences:
Email subscriptions:
We may send you email to any email address you provide for various informational and marketing purposes. For example, if you save a search, we’ll send you emails with new BPP on the market that match your search. If you save a listing, we’ll keep you posted on status updates such as a price change. When you use our transaction services, we’ll send you status updates and other information about your transaction. If you have an account with BPP, you can select your preferences through your account settings. Also, you can manage the types of email you receive by following the instructions included in each email we send you or by filling out our Email Opt Out Form. Please note that even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other non-advertising information.
Calls and texts:
We may collect your phone number when you use certain of our services, such as when you submit a “request info” or other inquiry form or create an account with us.
